1. General Provisions
These general terms and conditions of sale (“General Conditions”) apply to all sales of products (“Products” or “Product”) purchased through the website www.resetspirits.it (“Site”).
The remote sales service described in these General Conditions is reserved exclusively for consumers (“Customers” or “Customer”), defined as natural persons acting for purposes unrelated to their commercial, entrepreneurial, or professional activity, if any.
The sales service is available exclusively for deliveries in Italy, some European Union countries, Switzerland, and England. The contract can be concluded in Italian or English.
The Customer must carefully read the General Conditions, which are made available on the Site to allow their storage and reproduction, pursuant to Article 12 of Legislative Decree 9 April 2003, no. 70.
Contracts concluded with Reset Spirits S.r.l.s. through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, no. 206 (“Consumer Code”) and Legislative Decree 9 April 2003, no. 70 (“E-commerce Decree”).

3. Intellectual Property
All content on the Site (texts, images, logos, designs, trademarks, videos) is the exclusive property of Reset Spirits S.r.l.s. or its licensors and is protected by Italian and international copyright and industrial property laws.
Any reproduction, modification, or unauthorized use of the content is prohibited unless prior written authorization is provided by Reset Spirits S.r.l.s. or the rights holders.
The Customer may use the materials on the Site exclusively for purposes related to the purchase of the Products, in compliance with these General Conditions.
4. Product Information
Information regarding Products available for remote sale is provided on the Site, in accordance with Articles 52 and 53 of the Consumer Code.
Product images on the Site are for illustrative purposes only and may not perfectly represent the actual characteristics of the Product, which may differ in color, size, or accessories.
Reset Spirits S.r.l.s. undertakes to keep Product information up-to-date and accurate but cannot be held responsible for material errors or typos in product descriptions.
5. Price
Product prices include all taxes and are expressed in Euros.
For shipments within Italy, delivery is free if at least 2 products (even of different types) are in the cart. If the order contains only one product, shipping costs are borne by the Customer and are calculated automatically at purchase.
For shipments to other EU countries, shipping costs are always borne by the Customer and are calculated and communicated before order confirmation.
Reset Spirits S.r.l.s. does not ship to countries not listed in the “General Provisions” (Section 1) section of this document.
Any additional costs (e.g., for deliveries to remote areas) will be clearly indicated before order confirmation.
Prices may change, but the applicable price is the one published on the Site at the time the order is placed by the Customer.
In the event of a manifest error in the published price, Reset Spirits S.r.l.s. reserves the right to cancel the order and refund any amounts already paid by the Customer.
6. Product Orders
The essential features and prices of the Products are indicated in the offer for each Product. To purchase, the Customer must complete and submit the electronic order form to Reset Spirits S.r.l.s., following the instructions on the Site.
The Customer must add the desired Products to the “cart” and, after reviewing the General Conditions (including information on delivery costs, right of withdrawal, and Privacy Policy), select payment by credit or debit card (transaction managed by Stripe) and confirm the order by clicking the “Order and Pay” button or equivalent.
Before submitting the order, the Customer may correct any errors and modify the quantity or type of Products in the cart.
By submitting the order, the Customer declares to have read and fully accepted the General Conditions.
Order status and related communications will be sent by email to the address provided by the Customer.
Reset Spirits S.r.l.s. reserves the right to evaluate the acceptance of received orders and will notify the Customer of any inability to accept the order within 30 days of receipt, refunding any sums already paid.
7. Payment Methods
The Customer may pay for Products and related delivery costs exclusively by credit, debit, or prepaid card, using the secure Stripe payment system. Card data is managed directly by Stripe and is not accessible or stored by Reset Spirits S.r.l.s.
8. Order Confirmation
In accordance with Article 53 of the Consumer Code, the Customer will receive, without undue delay and in any case immediately after order receipt, a confirmation email containing:

a summary of the General Conditions of Sale,

the essential characteristics of the ordered product,

the price, total amount paid, and any shipping costs,

the existence of the right of withdrawal, with details on how and when to return the goods,
-
the address and contact details for any complaints,
-
information on customer service and existing commercial guarantees.
The Customer must keep the order confirmation as proof of purchase.
9. Invalidity of the Order
No contract shall be deemed concluded between Reset Spirits S.r.l.s. and the Customer until Reset Spirits S.r.l.s. has sent the order confirmation by email.
Reset Spirits S.r.l.s. reserves the right not to accept orders if there are reasonable grounds to believe that the Customer is not acting in good faith or is abusively exercising the right of withdrawal.
In such cases, the order will be considered void, and Reset Spirits S.r.l.s. will promptly inform the Customer by email, cancel any charges, and refund without delay – and in any case within 14 days – any sums already paid.
10. Shipping and Delivery
Products purchased on the Site will be delivered exclusively in Italy, some EU countries, Switzerland, and England, to the address indicated by the Customer at the time of order. Delivery cannot be made to P.O. boxes. Upon delivery, a person able to sign and show a valid ID proving legal age for the purchase of alcohol in the country of delivery must be present.
All purchases will be delivered by express courier from Monday to Friday, excluding holidays. Reset Spirits S.r.l.s. is not responsible for unforeseeable delays or delays attributable to the courier. The Customer will receive a shipping confirmation email with a tracking number.
Except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, Products will be delivered within a maximum of 30 days from the day after the order is submitted, unless otherwise communicated by Reset Spirits S.r.l.s. In case of unavailability, Reset Spirits S.r.l.s. will refund any amounts already paid within 14 days.
If, upon notification of a delivery delay, the Customer wishes to cancel the order, any amount already paid will be refunded within 14 days of the cancellation request.
For delivery, the Customer or their representative must be present at the recipient’s address. Upon delivery, the Customer must check that the number of packages matches the transport document and that the package is intact. Any damage or discrepancies must be immediately reported in writing on the courier’s delivery slip. Once signed, no further claims regarding the external characteristics of the package will be accepted.
Reset Spirits S.r.l.s. remains responsible for the integrity of the products until delivery to the Customer. In case of damage or loss during transport, the Customer has the right to request replacement or refund.
11. Right of Withdrawal
According to Legislative Decree 206/2005 (“Consumer Code”), the Customer has the right to withdraw from the purchase contract within 14 calendar days from delivery of the Products, without needing to provide reasons and without penalty.
To exercise the right of withdrawal, the Customer must inform Reset Spirits S.r.l.s. by sending an explicit communication by email to help@resetspirits.it or using the withdrawal form available on the Site.
Conditions for Withdrawal:
The right of withdrawal applies only to Products returned intact, unused, and in their original packaging with the seal unbroken.
For bottles of alcoholic beverages, the right of withdrawal lapses if the seal is broken or the bottle opened after delivery
Returning Products:
The Customer must return the Products without undue delay and in any case within 14 days from communicating the withdrawal. The deadline is met if the Products are shipped before the 14-day period expires.
Direct costs for returning the Products are borne by the Customer.
Until receipt at our warehouse is confirmed, the shipment is under the Customer’s responsibility, who must carefully package the Products to avoid damage during transport.
Refund:
Reset Spirits S.r.l.s. will refund all payments received from the Customer, including standard delivery costs (except for supplementary costs for non-standard delivery), without undue delay and in any case within 14 days from being informed of the withdrawal decision.
The refund will be made using the same payment method used by the Customer, unless otherwise agreed. The refund may be withheld until the Products are received or until the Customer proves they have returned the Products, whichever is earlier.
Limitations to the Right of Withdrawal:
Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded, among others, in the following cases

supply of goods made to measure or clearly personalized;
-
supply of goods that are liable to deteriorate or expire rapidly;
-
supply of sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery;
-
supply of alcoholic beverages, the price of which was agreed at the time of the contract, whose delivery can only take place after thirtydays and whose actual value depends on market fluctuations beyond the professional’s control.
The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
12. Non-Conformity of Products
In case of non-conformity of Products purchased from Reset Spirits S.r.l.s., the Customer must promptly contact Customer Service at assistenza@resetspirits.it, providing a detailed description of the defect and attaching the purchase receipt (or invoice, if issued on request).
Pursuant to Articles 128 et seq. of the Consumer Code, Products are covered by a legal guarantee of conformity valid for 2 years from delivery.
The defect must be reported within 2 months of discovery.
If a conformity defect is found, the Customer is entitled, free of charge, to replacement of the product or, if this is not possible (e.g., due to unavailability), to a refund of the amount paid.
The right to claim for non-conformity not fraudulently concealed expires in any case 26 months after delivery.
The legal guarantee applies only to consumer customers (natural persons purchasing for non-professional purposes).

13. Sale of Alcoholic Beverages
The sale of alcoholic beverages is prohibited to minors according to current legislation in the country of destination. By placing an order on the Site, the Customer declares that he has made the minimum age provided for the purchase of alcoholic beverages according to the current local legislation and to be aware of the relative legislative restrictions. It should be noted that, in Italy, the sale of alcoholic beverages is prohibited to minors of 18 years of age.
Reset Spirits S.r.l.s. reserves the right to verify the Customer’s age through reliable procedures, which may include requesting an identity document at purchase or delivery.
Delivery of alcoholic products will only be made to adults. The courier is authorized to request proof of age. If age cannot be verified or the recipient is underage, delivery will be refused and the order canceled.
The Customer assumes all responsibility for the truthfulness of the data provided during the purchase process.
14. Errors
Product information on the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, including price or product description errors.
Reset Spirits S.r.l.s. reserves the right to correct any errors, inaccuracies, or omissions at any time, including after an order has been placed, and to update information without notice.
In the event of a manifest error, especially regarding the price of an already ordered Product, Reset Spirits S.r.l.s. will promptly inform the Customer and reserves the right to cancel the order, providing a full refund of any amount paid.
The seller remains liable for non-conformity of Products under applicable law.
15. Applicable Law and Jurisdiction
These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws, without prejudice to any mandatory consumer rights under the law of the Customer’s habitual residence, if more favorable.
For any dispute relating to the interpretation, validity, and/or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the judge of the place of residence or domicile of the consumer, if located in Italy. In all other cases (e.g., if the Customer is not a consumer), exclusive jurisdiction lies with the Court of Marsala.
